Former School Resource Officer, who is employed by the Toledo Police Department, Matthew McCandless was arraigned on Monday and pleaded not guilty to charges of two counts of third-degree assault, two counts of first-degree criminal mistreatment and strangulation, all Class C felonies against a child under the age of 10. McCandless was arrested on December 21st on a secret indictment from the grand jury. The charges allege that McCandless caused injury to the child on his arm, chin and neck on Sept. 25.
McCandless was placed on administrative leave from the Toledo Police Department immediately after the department learned of the allegations against him and will remain on leave pending the results of criminal and internal investigations into the matter. The Lincoln County School District reported that as soon as they received word of the investigation he was no longer serving as a school resource officer at any of its schools. There is a no contact order in place with McCandless and the child. Mr. McCandless is being represented by Paul M. Ferder of Ferder, Casebeer, French, Stern & Gipson, LLP. There will be an early resolution conference February 7th.
