Recall Election Void-Commission Next Steps

A rare and somber situation has unfolded in Lincoln County after the recent passing of Lincoln County commissioner Claire Hall during the midst of a recall election intended to determine her tenure. County Clerk Amy Southwell said the election process has been voided in accordance with state statutes, which specify that the death of a candidate or subject of a recall can nullify the proceedings.


The recall election, now halted, prompted community reflection on both Commissioner Hall's years of public service and the protocols that guide such unexpected events. Commissioner Miller noted that “Regardless of differences that arise in public life, the loss of a colleague and community member is really a moment for reflection, compassion and respect,” expressing sympathy for the late commissioner’s family and colleagues, Miller added "My thoughts are with her family, loved ones and all those who worked alogside her during her years of service to Lincoln County."


Southwell also noted that such circumstances are exceptionally rare in this situation and, based on conversation with County counsel, and the state this has not previously been documented in Oregon. With the election voided, ballot drop boxes are being secured and receiving ballots will be retained under state law for two years. Financially, the recall has cost the county an estimated $25,000, and the cancellation is expected to prevent further expenditure. The costs will be covered by county funds. The focus now turns to the May election, when the vacated commission seat, along with others, will be open for candidates.


During the January 7th Board of Commissioners meeting both commissioners, Chuck and Miller, approved to have staff put together a plan with regard to the potential appointment process to fill in Commissioner Hall's seat. County Council Yuille noted that the winning candidate in the next election will serve out the remainder of Commissioner Hall's term.

Candidate filing is open now through March 10, with updated lists published on the county clerk's website. Only two individuals have filed for open positions so far, including current Commissioner Walter Chuck and community member Mitch Parsons of Lincoln City.
